Workplace Health and Safety

The WH&S Act differs from the previous OH&S Act by introducing the concept of due diligence for senior decision makers in the business. This means the Managing Director, CEO, Operations Manager and any others who have a significant influence in the running and/or resourcing of the company, have a personal responsibility under this act to ensure the health and safety of their workers. In the event of failure to comply with this duty personal fines and jail time can be handed down as punishment.

The new WH&S Act requires you to:

  • Have a good understanding of the risks in your workplace;

  • Direct appropriate resources to minimise risks;

  • Implement a risk management/Audit process; and

  • Have a consultation process with your employees.
